Sebi Imposes Rs 1 Lakh Fine on SMC Global Securities for Compliance Failures
The Securities and Exchange Board of India (Sebi) has issued a penalty of Rs 1 lakh to SMC Global Securities, a city-based stock broker, for violations related to regulatory compliance. The action follows an inspection focusing on the maintenance of client order-placement records and oversight of an authorized representative.
Sebi's thematic inspection covered the period from January through September 2024 and aimed to investigate complaints concerning unauthorized trading and the handling of client orders by the broker. The regulator found that SMC Global Securities failed to maintain proper records before order placement for certain clients. Additionally, the broker was unable to produce relevant documentation for several client orders during the review period.
Another significant finding related to the supervision of Amit Lilhare, an authorized person associated with SMC Global Securities. Sebi identified shortcomings in the monitoring of bank accounts where commissions were credited and in verifying payout requests submitted by clients. Out of 343 active clients assigned to Lilhare, 161 showed a consistent pattern of fixed payouts. These clients invested a total of Rs 6.11 crore, while payouts exceeded Rs 1.84 crore during the inspection timeframe.
These issues led Sebi to conclude that SMC Global Securities breached the Stock Brokers Regulations and other applicable market rules. The regulator's order, released on Thursday, highlighted the broker's failure to adhere to mandated compliance standards, emphasizing the importance of maintaining detailed and accurate client order records and ensuring adequate supervision of representatives.
SMC Global Securities operates under Sebi's jurisdiction and holds memberships across several major Indian stock exchanges, including the Bombay Stock Exchange (BSE), National Stock Exchange (NSE), Multi Commodity Exchange (MCX), and National Commodity and Derivatives Exchange (NCDEX). The company’s widespread presence in the financial markets underscores the need for strict compliance with regulatory frameworks to maintain market integrity and investor confidence.
The penalty imposed by Sebi reflects ongoing efforts by the regulator to tighten oversight of stock brokers and prevent irregularities that could affect market fairness. Maintaining transparent client records and supervising authorized persons effectively are critical components in safeguarding against unauthorized trading and protecting investor interests.
In recent years, Sebi has increased its scrutiny of brokerage firms to ensure compliance with operational norms, responding to rising concerns about market misconduct. This case involving SMC Global Securities is one among several regulatory actions aimed at promoting accountability and transparency in the capital markets.
For investors and market participants, the enforcement of such penalties serves as a reminder of the importance of dealing with brokers who strictly follow regulatory guidelines. It also highlights Sebi’s role in fostering a secure trading environment by holding intermediaries accountable for their compliance obligations.
As the financial sector continues to evolve, adherence to regulatory requirements remains essential for maintaining trust and stability in the markets. The incident with SMC Global Securities demonstrates the challenges brokers face in managing compliance and the consequences of lapses in record-keeping and supervision.
