CCPA Penalizes Hogar Technologies ₹1 Lakh for Misleading Walkie-Talkie Ads
The Central Consumer Protection Authority (CCPA) has levied a penalty of ₹1 lakh on Hogar Technologies and Innovations, a Kerala-based electronics firm, for running advertisements and product listings of walkie-talkies that failed to disclose critical regulatory information. This enforcement action was announced on Sunday by CCPA officials, highlighting concerns over consumer deception.
The authority pointed out that the advertisements did not mention important factors such as the devices' operating frequencies or the licensing requirements necessary for their lawful use. These omissions could lead consumers to mistakenly believe that the walkie-talkies could be operated legally without obtaining any regulatory permissions.
According to the CCPA, personal mobile radios that function within the frequency range of 446.0 to 446.2 megahertz are exempt from licensing requirements, provided certain conditions are met. However, walkie-talkies and other wireless devices operating outside this specific frequency band must comply with applicable regulatory standards and licensing rules.
This recent penalty against Hogar Technologies is part of a broader crackdown by the CCPA on misleading advertisements across various e-commerce platforms. An earlier investigation revealed over 16,970 listings of walkie-talkies that failed to meet compliance standards. The authority issued notices to 13 major online marketplaces, including Amazon, Flipkart, Meesho, Meta's Facebook Marketplace, JioMart, IndiaMART, and TradeIndia.
Following the investigation, the CCPA has already issued final orders against 12 of these entities, collectively imposing fines amounting to ₹58 lakh. These actions target deceptive advertising practices and unfair trade behavior, aiming to protect consumers by ensuring transparency and adherence to legal requirements.
The electronics market in India has witnessed rapid growth, with increasing consumer demand for communication devices like walkie-talkies, especially for personal, recreational, and business uses. Proper regulatory compliance for such devices is essential to avoid interference with licensed communication channels and ensure user safety.
Consumer protection authorities like the CCPA play a crucial role in regulating advertisements and product information, helping buyers make well-informed decisions. Accurate disclosure of device specifications, including operating frequency and licensing obligations, is vital for maintaining trust and legal conformity in the marketplace.
The CCPA's recent enforcement steps serve as a reminder for manufacturers, sellers, and online platforms to strictly adhere to advertising guidelines and regulatory standards. Consumers are also advised to verify the compliance status of wireless communication devices before purchase to avoid potential legal or operational issues.
